1.1. These rules for the purchase and sale of goods (hereinafter "Rules"), upon their approval by the Buyer (after familiarizing themselves with the Rules and checking the item "I have familiarized myself with and agree to the conditions for the purchase and delivery of goods"), are a legal document that establishes the online stores of the Buyer and Lina Normantienė (hereinafter – Seller or ambersee.com) rights and obligations, terms of purchase and payment for goods, order of delivery and return of goods, responsibility of the parties and other provisions related to the purchase of goods.
1.2. These rules are prepared in accordance with the laws of the Republic of Lithuania. The seller reserves the right to change, amend or add to the Rules at any time, taking into account the requirements established by legal acts.
2. CONCLUSION OF PURCHASE - SALE AGREEMENT
2.1. The agreement between the Buyer and the Seller is considered concluded when the Buyer clicks the "Confirm order" button after forming the shopping cart 2.2. Before pressing the "Confirm order" button, the Buyer must familiarize himself with these rules. The Buyer confirms familiarization with these rules by checking the box "I have read and agree with the Terms of Purchase and Delivery of Goods"
2.3. Each Buyer's order is registered and stored in the ambersee.com database
3. BUYER'S RIGHTS
3.1. The buyer has the right to purchase goods in accordance with the procedure established by these Rules and legal acts of the Republic of Lithuania.
3.2. The buyer has the right to refuse the contract for the purchase and sale of goods concluded with the ambersee.com online store, by notifying the Seller in writing (by e-mail, specifying the item to be returned and its order number) no later than within 7 (seven) working days from the delivery of the item or collection days, except for the cases provided for in the Civil Code of the Republic of Lithuania ( http://www3.lrs.lt/pls/inter3/dokpaieska.showdoc_l?p_id=493999&p_tr2=2 )
3.3. 3.2 of the rules. The Buyer's right provided for in point 2001 is implemented in accordance with August 17 By order of the Minister of Economy of the Republic of Lithuania no. 258 "On the approval of the rules for the sale of goods and the provision of services when contracts are concluded using means of communication".
3.4. The Buyer can try the right provided for in point 3.2 of the Rules only if the product has not been damaged or its appearance has not changed substantially, and it has not been used.
3.5. The right of return is not granted for all custom-made works and their frames, for which the work has been pre-defined and coordinated according to the wishes of the Buyer.
3.6. The Seller shall return to the Buyer an amount equal to the purchase price, excluding transportation, customs, import and export costs.
3.7. The seller is not responsible for the fact that the color, shape or other parameters of the goods displayed in the online store do not correspond to the real size, shape and color of the goods due to the characteristics of the display used by the Buyer.
4. BUYER'S OBLIGATIONS
4.1. The buyer must pay for the goods and accept them in accordance with the procedure established by these Rules.
4.2. The buyer, using the ambersee.com online store, undertakes to comply with these Rules, other conditions clearly indicated in the online store, and not to violate the laws of the Republic of Lithuania.
5. SELLER'S RIGHTS
5.1. If the Buyer tries to harm the stability and security of the online store or violates his obligations, the Seller has the right to limit or suspend his access to the online store immediately and without warning.
5.2. In the event of important circumstances, the Seller may temporarily or completely terminate the online store without notifying the Buyer in advance.
5.3. The Seller has the right to cancel the order without notifying the Buyer in advance, if the Buyer does not pay for the goods within 5 (five) working days.
5.4. When the Buyer chooses to pay for the goods in cash upon collection of the goods, but the Buyer cannot be contacted within 3 (three) working days, the Buyer's order is cancelled. 5.5. The seller has the right to unilaterally change these Rules by publishing the changed Rules on the website of the electronic store. Changes take effect from the moment of publication for all transactions concluded after publication.
6. SELLER'S OBLIGATIONS
6.1. The Seller undertakes to enable the Buyer to use the services provided by the ambersee.com online store under the conditions set out in these Rules and the online store.
6.2. The Seller undertakes to respect and protect the Buyer's privacy right to his personal information specified in the order form of the online store, in accordance with the laws of the Republic of Lithuania.
6.3. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer under the conditions specified in the rules.
6.4. The Seller, unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to offer an analogous or similar product as far as possible. If the Buyer refuses to accept an analogous or the most similar product, the Seller undertakes to return the money paid to the Buyer within 5 (five) working days, if prepayment was made.
7. PRICES OF GOODS, PAYMENT PROCEDURE AND TERMS
7.1 All prices of goods placed and sold in the electronic store www.ambersee.com are indicated in Euros
7.2 The transport fee is indicated when the order is created, until it is confirmed.
7.3. The buyer pays for the goods in one of the following ways:
7.3.1. Paysera banking system. After confirming the payment window, www.ambersee.com will direct you to the Paysera page and transfer the data about the amount to be paid to the electronic banking system.
7.3.2. Paypal transfer.
7.4. The buyer undertakes to pay for the order within 3 (three) working days from the day of order confirmation.
8. DELIVERY OF GOODS
8.1 When ordering goods, the buyer can choose the method of delivery of the goods, ie . use the goods delivery service provided by the Seller or pick up the goods at the address specified by the Seller.
8.2. Delivery of goods to the Buyer:
8.2.1. The buyer, who has chosen the delivery service during the order, undertakes to indicate the exact place of delivery of the goods.
8.2.2. The buyer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer has no right to make claims to the Seller regarding the delivery of the goods to the wrong entity.
8.2.3. The goods are delivered by the Seller or his authorized representative.
8.2.4. The ordered goods must be collected no later than within 5 (five) working days, counted from the confirmation by the Seller that the order has been "Delivered to the goods collection point" and can be collected.
8.2.5 The goods can only be collected by the recipient specified in the order. When picking up goods, it is necessary to have with you and present a valid personal identification document (identity card, passport or new model driver's license) to the post office employee.
8.3. In all cases, the Seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the fault of the Buyer or due to circumstances beyond the control of the Buyer.
8.4. During the delivery of the goods to the Buyer, the Buyer must check the condition of the shipment and the goods( s ) together with the Seller or his authorized representative and sign the shipment transfer - acceptance document. After the buyer signs the shipment transfer - acceptance document, it is considered that the shipment has been transferred in a suitable condition, there are no product damages, the origin of which cannot be attributed to a factory defect, and there are no inconsistencies in the product( s ) package (such as can be determined during the external inspection of the goods). Having noticed that the package of the delivered shipment is damaged (crumpled, wet or otherwise externally damaged), the product(s) is damaged and /or the product(s) is not properly assembled, the Buyer must note this in the shipment transfer - acceptance document and , in the presence of the Seller or his representative, to draw up a free-form shipment and/or product( s ) violation/nonconformity report. If the Buyer does not perform these actions, the Seller is released from responsibility towards the Buyer for damage to the goods, if the basis for the occurrence of such damage is not a factory defect, and for inconsistencies in the composition of the goods, if these inconsistencies can be determined during an external inspection of the goods.
8.5. The order is prepared and shipped within 1-2 working days, upon the buyer's request, a tracking code is indicated.
9. RETURNS AND EXCHANGE OF GOODS
9.1. The defects of the sold goods are removed, goods of unsuitable quality are replaced with goods of suitable quality and goods are returned based on the Retail Trade Rules ( http://www3.lrs.lt/pls/inter3/dokpaieska.showdoc_l?p_id=479161&p_tr2=2 ) Chapter 2, Section 1 ( EXCHANGE AND RETURN OF GOODS OF APPROPRIATE QUALITY) and the articles of Section 2 (EXCHANGE OF GOODS OF INADEQUATE QUALITY FOR GOODS OF APPROPRIATE QUALITY AND RETURN OF GOODS).
9.2. The Buyer has the right to return the goods by notifying the Seller in writing (by e-mail, indicating the desired return of the goods and its order number) no later than within 7 (seven) days from the day of delivery of the goods.
9.3. When returning goods to the buyer, it is necessary to comply with the following conditions:
9.3.1. the returned item must be in its original, neat packaging;
9.3.2. the product must be undamaged by the Buyer;
9.3.3. the item must be unused, without losing its merchandise appearance (label intact, protective film not torn off, etc.) (this clause does not apply in the case of returning a defective item);
9.3.4. the returned item must be in the same configuration as the one received by the Buyer;
9.4. In the event that the goods are returned based on the Buyer's right to return goods provided in these rules, the Buyer shall bear the costs of returning the goods. The seller's rates for returning goods are the same as when purchasing the goods. When the received wrong or low-quality goods are returned, the Seller undertakes to pick up such goods, replace them with similar goods and cover the costs of returning the goods. In the event that the Seller does not have similar goods, he returns the money paid for the item( s ) to the Buyer.
10. FINAL PROVISIONS
10.1. These rules are drawn up in accordance with the legal acts of the Republic of Lithuania.
10.2. All disagreements arising from the implementation of these rules shall be resolved by negotiation. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
